Abstract
The right to privacy is one of the most prominent rights that affect human freedom and dignity, as it limits interference with and unwanted exploitation of private data and information. In light of technological development and after individuals and institutions use modern communications technologies, many systems, information, and data have been compromised, which has prompted legislators in many countries to create a legal regulation that protects the right to privacy and ensures the safety of private. The Iraqi Constitution of 2005 defined the content of this right, and stipulated the inviolability of homes and correspondence, while the Iraqi Civil Law only stipulated the right to name and title, and did not address the civil liability arising from it.
